hitting a six (or homerun), is it legal under the health and safety legislation?

I love cricket (and I like baseball) well, I remember a six of the late Ben Hollioake in Durham hit a guardrail and almost took my head. Not cricket (or baseball) grounds have an exemption special health and safety laws? Personally I think the audience should be watching the game, but if my wife is beaned while stooping to pick up her knitting, what is the legal situation?

It's basically breaks the game. There is no way to legislate against being hit the head by a foul ball (I know nothing except that Cricket is a noisy insect). There were people trying to sue after you hit. They got nowhere because you take the risk that happening. I do not go to any sporting event and not paying attention. It seems stupid to me.
